Terms of Service
Version 2026-10-15
The agreement between you and rent-gpu.app. You accept it, with the Privacy Policy and Acceptable Use Policy, when you create an account.
Draft for legal review. This document describes how rent-gpu.app works today, but it has not yet been reviewed by counsel and may change before launch.
1. What rent-gpu.app is
rent-gpu.app is a marketplace. Independent hosts list GPU machines they own, and renters run containers on them. We run the website, the API, the software hosts install, the network relay that connects renters to machines, and billing. We do not own the listed machines. rent-gpu.app is operated by [company legal name], [registered address] (“we”, “us”).
2. Your account
- You must be at least 18 and able to enter a binding contract. If you sign up for a company, you confirm you may bind it.
- Give us a real email address and keep it current. We send billing, security and machine notices there.
- You are responsible for everything done with your account, your API keys and your organization’s members. Use two-factor authentication.
- One account can both rent and host.
3. Renting
- Hosts set their prices. You pay exactly the price shown on the listing. We add no fee to rentals.
- Usage is charged per second from prepaid credits: GPU time while an instance runs, disk while it exists, and bandwidth where the host charges for it.
- New organizations have an hourly spending cap, which we raise as your account builds history.
- When your balance reaches zero, your running instances stop. Their disks are kept for 72 hours so you can add credits, then destroyed.
- Stopping an instance keeps its disk and holds its GPUs for one hour. After that, the GPUs may be rented to someone else.
- Reliability, bandwidth and benchmark figures are measurements of past behaviour, not promises. Machines can fail or go offline.
- If an instance fails to start, or its machine stops responding, the credits and charges described in the Refund Policy apply automatically.
4. Hosting
If you list machines, the Host Agreement also applies to you. You accept it separately when you become a host.
5. Your data, and what hosts can see
You keep all rights to the images, code and data you run. You give us and the host only the permission needed to run them for you.
This machine is operated by an independent host. The host can access the disk and memory of your container. Do not place regulated or sensitive data here unless you encrypt it yourself. Choose a Datacenter or Isolated listing for stronger guarantees.
Hosts agree not to look at your workloads, and we ban hosts we catch doing so. We cannot prevent it technically on community machines. Destroying an instance deletes its disk. Keep your own backups.
6. Acceptable use
You must follow the Acceptable Use Policy. We may stop instances, suspend accounts or withhold payouts to stop a violation, to investigate an abuse report, or when the law requires it.
7. Payments, taxes and refunds
Card and stablecoin payments are processed by Stripe. We never see or store full card numbers, and we never hold your crypto: a stablecoin payment is converted to US dollars by Stripe. Prices and credits are in US dollars, and we collect sales tax or VAT where required. Refunds follow the Refund Policy. If you dispute a charge with your bank, we may suspend the account while the dispute is open.
8. Ending the agreement
You can stop using rent-gpu.app at any time. Destroy your instances first, because disks and anything on them are deleted when an account closes. We may suspend or close an account that breaks these terms or the Acceptable Use Policy, or that we must close by law. Where we can, we give notice first.
9. Disclaimers and limits of liability
The service is provided “as is”. Machines belong to independent hosts, and we do not promise any particular availability, performance or result. To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for lost profits, lost data or indirect damages. You will cover our costs from claims caused by what you run on the service or by your breach of these terms.
10. Changes
When we change these terms in a way that matters, we publish a new version here and ask you to accept it in the console. The version you accepted, and when, is recorded on your account.
11. Governing law
These terms are governed by the laws of [jurisdiction]. Disputes go to the courts of [venue], unless the law where you live gives you other rights.
